  • Non-US citizens are referred to as resident aliens or nonresident aliens.
  • If you spend most of your time in the US, via a green card, you will be considered a resident alien.
  •  If you do not have any immigration status or if you are in the US illegally, you will still be subject to the US tax laws.

  • If you maintain a home in another country and do not regularly reside in the US, you will most likely be considered a nonresident alien.
  • As a nonresident alien, you are subject to tax on your US source income and entitled to certain US tax deductions.
  • If you are currently a nonresident alien, but have plans to reside or immigrate to the US, you can reduce your exposure to US taxation by planning prior to obtaining resident alien status.
